Article 2 - Price

The prices of our products are indicated on the site in euros including all taxes, excluding participation in processing and shipping costs.

Cestcela.fr reserves the right to modify its prices at any time. When an order is placed, products will be invoiced based on the prices in effect at the time the order is validated.

The products remain the property of cestcela.fr until full payment of the price.

Special case of orders sent outside the European Union

When ordering from a country outside the European Union, you are the importer of the product(s) in question. Customs duties, local taxes, or import taxes may be payable. These fees are your responsibility, both in terms of declaration and payment. We advise you to check with your local authorities before placing your order.

Special case of orders in the European Union

Prices are inclusive of all taxes. Professionals with an intra-community VAT number can request an invoice excluding taxes by contacting our team in advance.

Article 3 - Processing and shipping costs

Processing and shipping fees are calculated based on weight, destination country, and delivery method selected. They include the preparation and shipping of your order.

  • Colissimo then Post of the destination country (2 to 7 working days depending on the country)

  • DPD (24 to 72 hours depending on the country)

  • DHL Express (24 to 48 hours depending on the country)

Article 5 - Validation of an order

Validation by the Client

You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Validating your order therefore constitutes acceptance of these General Terms and Conditions of Sale. For orders placed directly on our website or by telephone if you have provided us with an email address, you will receive an email confirming your order.

Unless proven otherwise, the data recorded by www.cestcela.fr constitute proof of all transactions between www.cestcela.fr and its customers.

Validation by cestcela.fr

Upon receipt of orders, cestcela.fr ensures the consistency of the data communicated. As part of its policy to combat fraudulent payments, cestcela.fr reserves the right to conduct any necessary investigations before confirming an order. This may include requesting proof of address or requesting your bank details. When such a procedure is initiated, the order validation is suspended. If the order is not confirmed within 15 days, the order will be canceled and the amounts paid refunded.

Article 6 - Products

Availability

Our product offers are valid as long as they are visible on the site, while stocks last.

In the event of unavailability of one of the products making up one of our gourmet baskets ordered on our site, we reserve the right to replace it with one or more products of equivalent or greater value, as long as this modification does not change the general spirit of the basket or its visual theme.

Article 7 - Delivery

Products are delivered to the delivery address or collection point indicated when ordering. Deliveries are made by the following services:

  • Colissimo then Post of the destination country (2 to 7 working days depending on the country)

  • DPD (24 to 72 hours depending on the country)

  • DHL Express (24 to 48 hours depending on the country)

Orders are shipped the same day for orders placed before 12pm, and the next day for orders placed after 12pm. Orders placed after 12pm on Friday are shipped the following Monday. Orders placed on Saturday or Sunday are shipped on Monday or Tuesday. Public holidays are considered Sundays.

Article 8 - Delivery times

When you confirm your order, you will receive an estimated delivery time. Our team will do everything possible to meet this estimate. However, this estimate remains indicative and non-contractualPlease note that delays may occur, particularly during high volume periods (such as Christmas), during public holidays in destination countries, or due to logistical disruptions.

If you are not there at the time of delivery, a delivery notice will be left. The recipient can collect the package at the designated location, providing proof of identity. If the package is not claimed within 9 to 15 days, depending on the country or delivery service used, it will be returned to us. We will notify you by email.

For any order provided with a recipient's mobile phone number, the recipient will be notified by the delivery service providing a delivery slot.

Article 9 - Delivery deadlines

The deadlines mentioned in Article 8 correspond to the generally observed deadlines. In accordance with current legislation, we undertake to deliver orders within the following deadlines:

  • To France : within a maximum period of 15 days following receipt of payment.

  • To the European Union and Switzerland : within a maximum period of 20 days following receipt of payment.


Article 10 - Payment

Payment for your purchases is made cash, by the following means:

  • By bank card directly on our secure site (Visa, MasterCard, American Express, e-Carte Bleue), via the solution Stripe, in conjunction with our CIC bank.

  • By bank card by phone.

  • By PayPal.

Orders are shipped only after receipt and full payment.No payment extension will be granted.

THE discount codes are applicable only to the amount of the products (excluding shipping costs), and provided that the amount of the order reaches at least the value of the voucher. Offers are not neither cumulative nor retroactive, and cannot be applied once the order has been validated. Vouchers giving entitlement to free products are valid while stocks last and until their expiration date.


Article 11 - After-Sales Service & Right of Withdrawal

In accordance with the provisions of the Consumer Code, you have a 15 days from receipt of your order to exercise your right of withdrawal, without having to provide a reason or incur a penalty.

The reimbursement of the products concerned will take place within a maximum period of 30 days from receipt of your request, subject to the return of the products in accordance with the terms and conditions.

⚠️ THE return costs remain the responsibility of the buyer.

THE open products, used, or whose packaging has been damaged cannot be refunded or exchanged.

Packages delivered late

In the event of non-compliance with delivery deadlines, That's it undertakes to carry out any necessary investigation with the carrier and to reimburse the initial shipping costs.
Apart from this reimbursement, any delay in delivery will not give rise to compensation, penalty, withholding or cancellation of a current order.
The customer will be informed as soon as possible of any delay observed.


Returned packages or delivery problems (not attributable to C'est Cela)

If a package is returned to us for one of the following reasons:

  • incomplete or incorrect delivery address,

  • package not collected within the allotted time,

  • refusal of receipt without valid justification,

then we will offer two solutions to the customer:

  1. Returning the order, upon payment of the initial shipping costs (as indicated when ordering) + 10 € of treatment.

  2. Refund of the order, deduced from the initial shipping costs + 10 € of treatment.

No claims will be accepted without prior notification from our logistics team.


Lost or undelivered packages

In the event of proven loss of the package by the carrier, and if the customer has never been delivered, That's it undertakes to carry out a reshipping at no extra cost.

The customer will however have to provide a affidavit of non-receipt, accompanied by a written commitment of refuse the package if it arrives later.
This certificate is essential for opening an investigation with the carrier or, where applicable, for filing a complaint.

Defective or damaged products

If the error is confirmed:

Article 12 - Reimbursement

  • Payment by credit card: refund via the Shopify Payments platform directly to the associated account.

  • Payment by transfer or check: reimbursement by check or credit note, sent to the billing address.

  • Partial or total payment by gift certificate : refund only in the form of a credit note, non-refundable in cash, card or check.


Article 13 - Responsibility of C'EST CELA

C'EST CELA cannot be held responsible for improper or non-compliant use of the products sold. Liability for defects attributable to the manufacturers or suppliers of the products remains their responsibility.
